Terms & Conditions
Last Updated September 2026
Welcome. These terms and conditions (the “Terms”) govern your use of www.packard.org, any other site we own, and our grantee portal (collectively, the “Sites”). Please read them carefully before accessing or using the Sites. The David and Lucile Packard Foundation (“Packard Foundation,” “we,” “us,” and “our”) Privacy Statement (www.packard.org/privacystatement) is part of and is incorporated into these Terms.
Acceptance of These Terms
If you do not agree to any provision of these Terms, you should discontinue use of the Sites and refrain from accessing them. By continuing to use the Sites, you accept these Terms in their entirety.
Ownership, Permitted and Prohibited Use of Content
The Packard Foundation owns or licenses the text, images, graphics, downloads, videos, ideas, features and functions (“Content”) on the Sites. All Content on the Sites is protected under copyright and other intellectual property laws, and the Packard Foundation and its licensors retain all rights in the Content.
Unless otherwise designated, the text Content on the Sites is licensed under the Creative Commons Attribution NonCommercial-NoDerivatives 4.0 International license (CC BY-NC-ND 4.0). In summary, you may read, browse, learn from, reproduce, and share the text Content provided that you (i) give the Packard Foundation appropriate credit, (ii) use it only for noncommercial purposes, (iii) do not share adapted or modified versions of it, and (iv) retain a notice referring to our disclaimers and include a link to the CC BY-NC-ND 4.0 license. Your use is governed by the full terms of the license, and nothing in these Terms limits the rights it grants.
All other Content found anywhere on the Sites (including in the Grantee Portal), including all logos, publications, photographs, videos, and other media, is not offered under the CC BY-NC-ND 4.0 license.
When you reuse our text Content, we ask that you preserve its meaning and context, and that you not incorporate it into other material in a way that might mischaracterize our work, make historical work appear current, or lead others to draw incorrect conclusions about our work.
If you wish to make any other use of the Content, please contact us and we will consider your request.
License to the Packard Foundation for User Submissions
The Sites may allow you to submit or otherwise provide content to us, including responses to questionnaires, forms, or surveys, and any comments, messages, images, or other materials you send to us through the Sites (collectively, “User Submissions”). You retain any ownership rights you hold in your User Submissions.
By providing a User Submission, you grant the Packard Foundation a non-exclusive, worldwide, royalty-free license to use, reproduce, store, adapt, modify, and translate your User Submission in connection with operating the Sites and carrying out the Packard Foundation’s charitable purposes.
You represent and warrant that (a) you own or otherwise have all rights necessary to grant this license; (b) your User Submission does not infringe or violate the rights of any third party, including intellectual property, privacy, or publicity rights; and (c) your User Submission complies with these Terms and all applicable laws.
We are not obligated to use, store, or return any User Submission, and we may remove or delete any User Submission at our discretion. Any personal information contained in a User Submission is handled in accordance with our Privacy Statement.
Changes to These Terms
We reserve the right to modify or amend these Terms from time to time without notice. Your continued use of the Sites following the posting of changes to these Terms will mean you accept those changes.
Prohibited Conduct
You may not interfere with the content or functionality of the Sites. In particular, you may not disassemble, alter, reverse engineer, scrape, or disrupt—or attempt to disrupt—any functions of the Sites.
Third-Party Websites
The Sites may contain links to third-party websites. Such links do not constitute our endorsement or approval of those websites. We are not responsible for their content, for any disputes arising from them, or for any viruses or other harmful components you may encounter through them. You access third-party websites at your own risk and should review their terms as well.
Trademarks
THE DAVID & LUCILE PACKARD FOUNDATION and the Packard Foundation logos on the Sites are trademarks of The David and Lucile Packard Foundation.
Privacy
For information regarding how we collect, handle, and share personal information, or information submitted to us in response to a questionnaire on the Sites, please review our Privacy Statement at www.packard.org/legal/.

FURTHER, THE PACKARD FOUNDATION ASSUMES NO RESPONSIBILITY FOR COMPUTER VIRUSES OR OTHER SYSTEM INTERRUPTION RESULTING FROM USE OF THE SITES. THE SITES AND THEIR CONTENT ARE MADE AVAILABLE ONLY TO PROVIDE INFORMATION ABOUT THE PACKARD FOUNDATION. THE PACKARD FOUNDATION MAINTAINS THE SITES IN THE UNITED STATES, AND MAKES NO REPRESENTATION THAT THE SITES, OR ANY CONTENT ON OR ACCESSED THROUGH THE SITES, ARE APPROPRIATE OR AVAILABLE FOR USE IN OTHER JURISDICTIONS. Limitation of Liability & Damages Cap
The Packard Foundation does not assume any responsibility for, and will not be liable for, any damages to, or any viruses that may infect, your computer, telecommunication equipment or other property caused by or arising from your access to, use of, or browsing the Sites, or your downloading of any information or materials from the Sites. We do not guarantee continuous, uninterrupted or secure access to the Sites, and operation of the Sites may be interfered with by numerous factors outside of our control. The foregoing limitations of liability do not apply to the extent prohibited by law. Please refer to your local laws for any such prohibitions. In the event of any problem with the Sites or any content, you agree that your sole remedy is to cease using the Sites. In no event shall the Packard Foundation’s total liability to you for all damages, losses and causes of action whether in contract, tort (including, but not limited to, negligence), or otherwise exceed twenty-five dollars ($25.00).
Right to Terminate or Suspend Access
We may, at our discretion and at any time, suspend, restrict, or terminate your access to all or any part of the Sites, with or without notice and for any reason or no reason, including if we believe you have violated these Terms or applicable law. We may also modify, suspend, or discontinue all or any part of the Sites at any time without notice.
You may stop using the Sites at any time. Upon any suspension or termination, your right to access and use the Sites will immediately cease. The Packard Foundation will not be liable to you or any third party for any suspension, restriction, termination, or discontinuation of access to the Sites.
Sections of these Terms that by their nature should survive will continue to apply after your access ends, as set out in the Survival section.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
Severability
If any provision of these Terms is held to be invalid or unenforceable, it will be modified to the extent necessary to make it enforceable, which may include deleting it, and the remaining provisions shall be enforced.
Entire Agreement
These Terms and any: (a) notices, terms, or other items incorporated herein; (b) additional terms and conditions contained on the Sites, as a part of your participation in a particular activity, or related to any Content; and (c) any additional consents or agreement provided by you on or in connection with the Sites or any Content, service or other activity, constitute the entire agreement between you and the Packard Foundation and supersede any prior understandings or agreements (written or oral).
Survival
The following sections will survive any termination or expiration of these Terms: Ownership, Permitted and Prohibited Use of Content; Trademarks; Third-Party Websites; Privacy; Disclaimers; and Governing Law.
